WhatsApp Business Messaging Policy

This policy applies when you use Furcata to send messages through WhatsApp. It supplements our Terms of Use, Acceptable Use Policy, and Messaging Policy.

WhatsApp is operated by a third party and is subject to its own terms and policies. When you use WhatsApp through Furcata, you must comply with both our policies and the applicable WhatsApp and Meta business terms and policies. Where those third-party terms are stricter than ours, the stricter requirement applies.

1. Opt-In and Consent

  1. You must obtain opt-in from each recipient before sending them WhatsApp messages, and you are solely responsible for determining and documenting the method of opt-in.
  2. Opt-in must be obtained through a clear affirmative action and must identify your business as the sender.
  3. You must not send messages to recipients who have not opted in, and you must not buy, rent, or share opt-in lists.
  4. You must honor opt-out requests promptly and must not re-add a recipient who has opted out without a new, valid opt-in.

2. Message Templates and the Customer Service Window

  1. Business-initiated messages must use a message template that has been approved through the applicable WhatsApp process.
  2. You are responsible for the content of your templates and for ensuring they comply with WhatsApp's template guidelines and our Acceptable Use Policy.
  3. Outside the customer service window, you may only send approved template messages. Within the window, you may reply freely to the recipient's message.
  4. We may reject, pause, or remove templates or messaging that we believe violate these requirements.

3. Prohibited Content and Conduct

In addition to the prohibitions in our Acceptable Use Policy, you must not use WhatsApp through Furcata to send content that is prohibited by WhatsApp's business policies, including content related to illegal products or services, deceptive or fraudulent offers, or content that is otherwise restricted.

4. Quality Rating and Enforcement

  1. WhatsApp assigns a quality rating to your business based on recipient feedback and other signals.
  2. A low quality rating or a high rate of blocks or reports may result in messaging limits, template rejections, or suspension of your WhatsApp messaging.
  3. We may suspend or terminate your access to WhatsApp messaging if you breach this policy or the applicable third-party terms.

5. Your Responsibility and Indemnity

You are responsible for your use of WhatsApp through Furcata, including your opt-in practices, your template content, and your compliance with the applicable third-party terms. You agree to indemnify and hold Furcata harmless from claims arising out of that use.
