Furcata, Inc. ("Furcata", "Company", "we", "us", or "our") is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, share, retain, and safeguard information when you access our website at furcata.com, our applications, and our messaging services (together, the "Services"), and it describes the rights and choices available to you.
For purposes of this Privacy Policy, "Site" refers to our website, which can be accessed at furcata.com or through our mobile application "Furcata". "Service" refers to our services accessed via the Site, through which users can create accounts, generate or consume content using artificial intelligence, obtain phone numbers, send SMS, MMS, and voice messages in bulk, use voicemail, create or consume media content, use chat and content-generation features, and connect with external services. "You" refers to you, as a user of our Site or our Service. By accessing our Site or our Service, you accept this Privacy Policy and our Terms of Use, and you consent to our collection, storage, use, and disclosure of your information as described in this Privacy Policy.
I. Information We Collect
We collect "Non-Personal Information" and "Personal Information". Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information, referring and exit pages and URLs, platform types, preferences you submit, preferences generated based on the data you submit, and number of clicks. Personal Information includes your email address, phone number, date of birth, language, picture, and other contact information that you submit to us through the registration process and on your profile page.
- Information collected via technology. To activate the Service you do not need to submit any Personal Information other than your email address or cellphone number. To use the Service thereafter, you do need to submit further Personal Information, which may include date of birth, language, picture, and location. To improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (the "referring URL"), the type of browser you use, the device from which you connected, the time and date of access, and other information that does not personally identify you. - Information you provide by registering for an account. To become a subscriber to the Service you will need to create a personal profile by registering with the Service and entering your email address and creating a user name and a password. By registering, you authorize us to collect, store, and use your email address in accordance with this Privacy Policy.
- Customer content and messaging data. When you use the Services to send messages to your own contacts, you (or the account you use) provide us with the content of those messages and the contact data you upload or import, including phone numbers, names, and any attributes you associate with them. We process this data on your behalf and at your direction as a service provider and data processor. Our Data Processing Addendum governs that processing.
- Payment and billing information. If you purchase credits or a paid plan, our payment processing partners collect and process your payment card details. We do not store full payment card numbers on our systems.
- Children's privacy. The Site and the Service are not directed to anyone under the age of 18, and we do not knowingly collect or solicit information from anyone under the age of 18 or allow anyone under the age of 18 to sign up for the Service. If we learn that we have gathered personal information from anyone under the age of 18 without the consent of a parent or guardian, we will delete that information as soon as possible. II. How We Use and Share Information
Personal Information. Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent, or otherwise share for marketing purposes your Personal Information with third parties without your consent. We share Personal Information with service providers who perform services for the Company, such as providers of cloud infrastructure, email delivery, payment processing, analytics, and carrier and messaging network partners who deliver the messages you send. Those providers use your Personal Information only at our direction and in accordance with our agreements with them. In general, the Personal Information you provide to us is used to help us communicate with you, to provide and operate the Services, to contact users in response to questions, to solicit feedback, to provide technical support, and to inform users about promotional offers. We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; to address fraud, security, or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
Non-Personal Information. In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information, and we reserve the right to use and disclose such Non-Personal Information to our partners and other third parties at our discretion. In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. Mobile information. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
III. Legal Bases for Processing
Where the General Data Protection Regulation (GDPR), the UK GDPR, or similar laws apply, we process Personal Information on the following legal bases: to perform our contract with you and provide the Services; to pursue our legitimate interests in operating, securing, and improving the Services, where those interests are not overridden by your rights; to comply with legal obligations; and, where required, on the basis of your consent, which you may withdraw at any time. Where we process customer content and contact data on behalf of a customer, we act as a processor and the customer is the controller; our Data Processing Addendum governs that relationship.
IV. Your Rights Regarding the Use of Your Personal Information
Subject to applicable law, you have the right to: access the Personal Information we hold about you; request correction of inaccurate information; request deletion of your information; request restriction of or object to certain processing; request portability of information you provided to us; and withdraw consent where processing is based on consent. If you are a resident of California or another US state with a comprehensive privacy law, you also have the right to know the categories of information we collect and how it is used and disclosed, to request deletion, to correct inaccurate information, to opt out of the sale or sharing of personal information, and to not be discriminated against for exercising your rights. We do not sell your Personal Information.

You may designate an authorized agent to make a request on your behalf where the law permits. If you are a contact of one of our customers and wish to exercise rights over data that customer provided to us, please contact that customer directly; we will assist them in responding to your request.
V. Data Retention and International Transfers
We retain Personal Information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Our Data Retention and Deletion Policy describes the retention periods that apply to each category of data and how data is deleted. We and our service providers may process information in countries other than your own. Where we transfer Personal Information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as the standard contractual clauses, as further described in our Data Processing Addendum.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. VII. Links to Other Websites
As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. The Company reserves the right to change this policy and our Terms of Use at any time.
