Mobile Terms of Service for SMS/MMS/Voice Messaging

These Mobile Terms of Service ("Mobile Terms") govern the SMS, MMS, RCS, and voice messaging that Furcata, Inc. ("Furcata", "we", "us") sends to you as a message recipient. They also set out the obligations that apply to you as a recipient. They supplement, and do not replace, our Terms of Use and our Messaging Policy. Where these Mobile Terms conflict with the Terms of Use on a messaging-specific point, these Mobile Terms control.
I. Who These Terms Apply To
- These Mobile Terms apply to you as an individual recipient of messages sent using Furcata by a business or organization that has chosen to contact you.
- Furcata is a technology provider. The business or organization that contacted you is the message sender, and is solely responsible for the content of the messages you receive and for obtaining your consent to receive them.
- You must be at least 18 years old to consent to receive recurring marketing messages. Where a sender's message program is directed at minors, that sender is responsible for obtaining any consent required from a parent or guardian.
II. How You Opt In
- You opt in when you give the sender your mobile number for the purpose of receiving messages, when you text a keyword to a sender's number, when you submit a web form that clearly discloses that you agree to receive messages, or when you provide consent through another method that satisfies applicable law.
- Consent must be given by the person who owns or is the customary user of the mobile number. You may not opt in on behalf of another person, and you may not enter a number that is not yours.
- By opting in, you confirm that the mobile number you provided is yours, that you are authorized to consent to receive messages at that number, and that the information you provided is accurate.
III. How You Opt Out
- You can opt out of SMS, MMS, or RCS messages at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive. A single opt-out keyword stops all further messages from that sender.
- You can opt out of voice messages by following the opt-out instructions provided in the call, or by contacting the sender directly.
- After you opt out, you may receive one final confirmation message. No further messages will be sent to you unless you opt in again.
- If you would like help, reply HELP to any message, or contact the sender at the contact details in their messages.
IV. Message Frequency and Charges
- Message frequency varies by program. The sender is required to disclose the expected message frequency at the point of opt-in.
- Message and data rates may apply. Your mobile carrier may charge you for each message you send or receive according to your plan. Furcata does not charge message recipients.
- Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
V. Content of Messages
Message content is determined by the sender and may include promotional offers, appointment reminders, order and delivery updates, account notifications, customer service responses, and other information the sender has told you about. Furcata does not author, control, or pre-screen the content of messages sent by senders, and does not endorse it.
VI. Prohibited Content and Conduct
Senders are prohibited from using Furcata to send messages that:
- Are illegal, or that promote illegal activity.
- Relate to sex, hate, alcohol, firearms, or tobacco ("SHAFT") content in violation of applicable law or carrier requirements.
- Constitute unsolicited advertising or spam.
- Are deceptive, fraudulent, or misleading, including phishing, spoofing, or impersonation.
- Infringe the intellectual property, privacy, or publicity rights of others.
- Contain malware or links to malicious content.
- Harass, threaten, abuse, or defame any person.
- Relate to gambling, cannabis, debt collection, high-risk financial services, or other restricted categories without the registrations and consents those categories require.
If you receive a message that violates these rules, please report it to us using the process described in our Abuse Reporting Policy.
VII. Consent, Records, and Compliance
- Senders are solely responsible for obtaining and maintaining valid consent, for honoring opt-out requests, and for complying with all applicable laws and industry requirements, including the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, the CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), the GDPR and ePrivacy Directive where applicable, and applicable carrier, registry, and campaign-registration requirements.
- Senders must maintain records of consent and opt-out requests and provide them to Furcata or to a carrier or regulator on request.
- Furcata may suspend or terminate any messaging program that fails to meet these requirements, and may do so without notice where required by law or by a carrier.
VIII. Privacy
- We do not sell your mobile number, and we do not share mobile opt-in data or consent with third parties or affiliates for their own marketing or promotional purposes. This exclusion applies to all categories of information collected in connection with a messaging program.
- We process mobile numbers and message data to deliver messages, to maintain records required by law and by carriers, to prevent abuse, and to comply with legal obligations.

IX. Disclaimer and Limitation of Liability
- To the maximum extent permitted by law, the messaging service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- To the maximum extent permitted by law, Furcata will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to messaging.
- Nothing in these Mobile Terms limits any liability that cannot be limited under applicable law, including liability arising from our own fraud, willful misconduct, or gross negligence.
X. Termination
- You may terminate your participation at any time by opting out as described in Section III.
- The sender or Furcata may terminate a messaging program at any time, with or without notice, including where required by law, by a carrier, or to prevent abuse.
XI. Governing Law and Dispute Resolution
- These Mobile Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
- Any dispute arising out of or relating to these Mobile Terms is subject to the dispute resolution and arbitration provisions in our Terms of Use, including the agreement to resolve disputes through binding individual arbitration rather than in court.
XII. Changes to These Terms
We may revise these Mobile Terms at any time by posting the revised version on this website. The revised version takes effect when posted, and the "Last revised" date above will be updated. Your continued participation in a messaging program after a revision takes effect constitutes acceptance of the revised terms.
