Messaging Policy

This Messaging Policy sets out the rules that apply when you use Furcata to send messages to your contacts. It forms part of, and is incorporated into, our Terms of Use and our Acceptable Use Policy. It applies to SMS, MMS, RCS, WhatsApp, and voice messaging.

1. Who Is Responsible for Consent

  1. You, the customer, are the message sender. You are solely responsible for obtaining and maintaining valid consent from each of your contacts before you send them any message.
  2. Furcata is a technology provider. We transmit the messages you direct us to send. We do not determine who you message, what you say, or when you say it.
  3. You must be able to demonstrate consent on request. If a carrier, a registry, a regulator, or Furcata asks you to prove that a contact consented, you must be able to produce that evidence.

2. Opt-In Requirements

  1. Consent must be given by the person who owns or is the customary user of the mobile number. You may not opt in on behalf of another person.
  2. Consent must be clear, informed, and specific to the messaging program. A pre-checked box, a bundled consent, or a condition of purchase is not valid consent.
  3. At the point of opt-in you must disclose: the identity of the sender, the fact that the contact will receive recurring messages, the expected message frequency, that message and data rates may apply, and how to opt out.
  4. You must keep a record of the opt-in, including the date, time, source, and the exact language the contact agreed to.

3. Opt-Out and Help

  1. Every message you send must include a clear and conspicuous opt-out instruction.
  2. You must honor the following opt-out keywords: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT. You may support additional keywords, but you may not support fewer.
  3. You must honor the HELP keyword by responding with a help message that identifies the sender and provides a support contact.
  4. Opt-out requests must be honored immediately and in all cases within the time required by applicable law and carrier requirements. You may send one final confirmation message.
  5. You may not require a contact to take any further action, or to log in, in order to opt out.

4. Sending Times and Frequency

  1. You must send messages only during the hours permitted by applicable law and carrier requirements. As a general rule, do not send marketing messages before 8:00 a.m. or after 9:00 p.m. in the recipient's local time zone.
  2. You must respect the message frequency you disclosed at opt-in. Do not send more messages than the contact agreed to receive.
  3. You must not send messages on days or at times prohibited by law in the recipient's jurisdiction.

5. Sender Identification

  1. Every message must clearly identify the sender. You may not obscure, falsify, or misrepresent the originating number or sender identity.
  2. You may not spoof, alter, or manipulate caller ID, sender ID, or message headers.
  3. You must comply with the Truth in Caller ID Act, the TRACED Act, and applicable STIR/SHAKEN authentication requirements.

6. Prohibited Content and Conduct

You may not use Furcata to send messages that:

  • Are illegal, or that promote or facilitate illegal activity.
  • Relate to sex, hate, alcohol, firearms, or tobacco (SHAFT) content in violation of applicable law or carrier requirements.
  • Constitute unsolicited advertising or spam.
  • Are deceptive, fraudulent, or misleading, including phishing, spoofing, or impersonation.
  • Contain malware or links to malicious content.
  • Harass, threaten, abuse, or defame any person.
  • Infringe the intellectual property, privacy, or publicity rights of others.
  • Relate to gambling, cannabis, debt collection, high-risk financial services, or other restricted categories without the registrations and consents those categories require.

7. Record-Keeping

  1. You must maintain records of consent, opt-out requests, and message content for at least the period required by applicable law and carrier requirements, and in no event for less than four years.
  2. You must provide those records to Furcata, a carrier, or a regulator on request.

8. Enforcement

  1. We may monitor for compliance with this policy, investigate complaints, and suspend or terminate any messaging program that violates it.
  2. We may suspend or terminate a program without notice where required by law, by a carrier, or to prevent ongoing harm.
  3. We may report violations to carriers, registries, and law enforcement where appropriate.
