Copyright and DMCA Policy

Furcata respects the intellectual property rights of others and expects our customers and their contacts to do the same. This policy explains how we handle claims that content made available through the Services infringes a copyright.

This policy is part of, and is incorporated into, our Terms of Use. It applies to content you upload, send, or store through the Services, including message content, media, templates, and any material hosted on your behalf.

1. Our Role

  1. Furcata is a technology provider that transmits and stores content at the direction of our customers. We do not review content before it is sent.
  2. We do not control, and are not responsible for, the content our customers send to their contacts.
  3. We respond to valid notices of claimed infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable law.

2. Reporting Claimed Infringement

If you believe that content available through the Services infringes your copyright, send a written notice to our Designated Copyright Agent at copyright@furcata.com. To be effective, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the material claimed to be infringing, with enough detail for us to locate it, such as the URL, message identifier, or account involved.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

We may forward your notice, including your contact information, to the person who posted the content and to relevant third parties as required by law.

3. Counter-Notice

If your content was removed and you believe the removal was the result of a mistake or misidentification, you may send a counter-notice to copyright@furcata.com. To be effective, your counter-notice must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located, or, if your address is outside the United States, for any judicial district in which Furcata may be found, and that you will accept service of process from the person who provided the original notice.

If we receive a valid counter-notice, we may restore the removed material in accordance with the DMCA, unless the original complaining party notifies us that it has filed a court action.

4. Repeat Infringers

  1. We maintain a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers.
  2. We may also suspend or terminate access to the Services for any customer who repeatedly or materially infringes the rights of others.

5. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or Furcata.

6. Trademarks and Other Rights

This policy addresses copyright only. If you believe your trademark, privacy, publicity, or other rights have been violated, contact us at support@furcata.com and we will review your report under our Abuse Reporting Policy.
