Artificial Intelligence Terms

These Artificial Intelligence Terms govern your use of Furcata features that use artificial intelligence, including AI voice agents, AI-assisted message drafting, automated replies, and any other feature we identify as AI-powered (the "AI Features").

These terms are part of, and are incorporated into, our Terms of Use. If there is a conflict between these terms and the Terms of Use on a matter specific to the AI Features, these terms control.

1. Your Responsibilities

  1. You are responsible for how you configure and use the AI Features, including the scripts, prompts, knowledge sources, and instructions you provide.
  2. You must obtain all consents and permissions required by law before using AI Features to contact anyone, including consent to call or message the recipient.
  3. You must comply with all applicable laws on automated calls and messages, including rules on artificial or prerecorded voices, autodialers, and caller identification.
  4. You must not use AI Features to impersonate any person or organization, to deceive recipients, or to generate content that is unlawful, misleading, or harmful.
  5. You must review AI-generated output before relying on it for any decision that affects a person's rights, safety, or access to services.

2. Disclosure and Call Recording

  1. Where required by law, you must disclose that the recipient is interacting with an AI system rather than a human, and you must do so clearly and at the start of the interaction.
  2. If you record calls or conversations, you are responsible for obtaining any consent required by applicable law, including in jurisdictions that require the consent of all parties.
  3. You must provide any notices and offer any opt-out or objection rights that applicable law requires for automated processing.
  4. You must not use AI Features to clone or synthesize a person's voice or likeness without that person's documented permission and any disclosure required by law.

3. Our Role and Limitations

  1. AI Features are assistive tools. They may produce output that is inaccurate, incomplete, or unsuitable for your purpose.
  2. We do not guarantee any particular result, level of accuracy, or fitness for a particular use.
  3. We are not responsible for decisions you make, or actions you take, based on AI-generated output.
  4. We may modify, limit, or discontinue any AI Feature at any time.

4. Data and Training

We do not use your customer content to train general-purpose AI models. We may process your content to provide the AI Features to you, to secure and operate the Services, and as described in our Privacy Policy and Data Processing Addendum.

5. Prohibited Uses

You must not use AI Features to:

  1. Generate or distribute content that is unlawful, defamatory, harassing, or discriminatory.
  2. Deceive recipients about the identity of the caller or sender.
  3. Make automated decisions about individuals in areas such as credit, employment, housing, healthcare, or education without the safeguards required by law.
  4. Circumvent any consent, opt-out, or do-not-call requirement.

6. Indemnity

You agree to indemnify and hold Furcata harmless from claims arising out of your use of the AI Features, including claims relating to consent, disclosure, call recording, impersonation, or the content you direct the AI Features to produce.
