Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes the rules that apply when you use the Furcata messaging platform, including our application programming interfaces, dashboards, integrations, and any messaging channel we support (SMS, MMS, WhatsApp, voice, and related services). It forms part of, and is incorporated into, our Terms of Use. Capitalized terms not defined here have the meaning given in the Terms of Use.

You are responsible for everything sent through your account, including messages sent by your employees, contractors, agents, and any third party you authorize. You must ensure that everyone who uses your account complies with this AUP.

1. Consent and Opt-In

You may only send messages to recipients who have given you the consent required by applicable law. You are solely responsible for obtaining, documenting, and maintaining that consent, and for demonstrating it to us, to carriers, or to a regulator on request.

  • Obtain prior express written consent where required (for example, under the U.S. Telephone Consumer Protection Act for marketing and automated messages).
  • Keep records of how, when, and where each recipient opted in, including the exact disclosure language shown at the point of collection.
  • Do not send messages to purchased, rented, scraped, or otherwise obtained lists, or to numbers you cannot prove consented.
  • Honor opt-out requests promptly and permanently, and never re-add a recipient who has opted out.

2. Prohibited Content

You may not use Furcata to send, route, or facilitate content that is unlawful or that violates carrier, network, or channel rules. Prohibited content includes, without limitation:

  • Sex, hate, alcohol, firearms, and tobacco (the categories commonly referred to as SHAFT), and any other content prohibited by a carrier or messaging channel.
  • Phishing, smishing, spoofing, social engineering, or any attempt to deceive a recipient about the identity of the sender.
  • Fraud, scams, pyramid or Ponzi schemes, deceptive investment or financial offers, and illegal or deceptive gambling.
  • Malware, ransomware, spyware, or links to any of the foregoing.
  • Content that infringes intellectual property, violates privacy or publicity rights, or is defamatory or harassing.
  • Content that exploits or harms minors, or that is directed to children in violation of applicable law.
  • Content that violates export control or sanctions laws, or that is directed to a sanctioned person or region.

3. Prohibited Conduct

  • Sending unsolicited bulk messages, or sending at volumes or patterns that indicate spam.
  • Falsifying, forging, or manipulating sender identifiers, headers, or origin information.
  • Using the platform to evade a carrier, channel, or regulatory restriction, or to circumvent a suspension.
  • Interfering with, probing, or attempting to gain unauthorized access to the platform or another customer's account.
  • Reselling or sublicensing the platform without our written authorization.
  • Using the platform in a way that damages our reputation or the deliverability of other customers.

4. Restricted and High-Risk Categories

Some categories require additional review, registration, or carrier approval before you may send. These include, for example, political and advocacy messaging, debt collection, lead generation, high-risk financial services, healthcare and medical reminders, cannabis, gambling, and any category subject to a channel-specific policy. We may require you to complete additional verification, and we may decline or suspend traffic in these categories at our discretion.

5. Channel-Specific Rules

Each messaging channel has its own rules, and you must comply with all of them. For WhatsApp, you must follow the WhatsApp Business Messaging Policy, including opt-in requirements, approved message templates, and the customer-service window. For voice and artificial-intelligence features, you must comply with our Artificial Intelligence Terms, including call-recording consent and disclosure requirements. For messaging generally, you must comply with our Messaging Policy.

6. Monitoring, Investigation, and Enforcement

We are a technology provider and do not pre-screen or routinely monitor the content of your messages. However, we may review content, metadata, and sending patterns when we receive a complaint, when a carrier or channel partner raises a concern, when we detect a risk of harm or a legal violation, or when we are required to do so by law. We may investigate any suspected violation of this AUP.

If we believe you have violated this AUP, we may, with or without notice and at our sole discretion: request information or remediation; throttle, filter, or block specific traffic; suspend or terminate your account or a specific sender, number, or campaign; and report the matter to carriers, channel partners, or law enforcement. We are not liable to you for any action we take in good faith to enforce this AUP.

7. Reporting Abuse

If you believe someone is using Furcata to send unlawful, deceptive, or harmful messages, please report it to us. See our Abuse Reporting Policy for how to submit a report and what information to include.

8. Your Responsibility and Indemnity

You are solely responsible for your content, your recipient lists, your consent records, and your compliance with all applicable laws, carrier rules, and channel policies. You agree to indemnify and hold Furcata harmless from any claim, fine, penalty, or loss arising from your use of the platform or your violation of this AUP, as further described in the Terms of Use.

9. Changes to This Policy

We may update this AUP from time to time to reflect changes in law, carrier or channel requirements, or our services. We will post the updated version on this page and update the revision date. Your continued use of the platform after an update means you accept the revised AUP.
